These Terms of Service (“Terms”) govern your use of the Operithm website and services (“Service”). By accessing or using the Service, you agree to be bound by these Terms.

1. AI-Generated Content Disclaimer

Reports are for informational and educational purposes only. They do not constitute professional legal, financial, investment, tax, accounting, or any other form of licensed professional advice. Consult a qualified professional before making decisions based on report content.

2. No Guarantee of Accuracy

AI models can produce inaccurate, incomplete, or outdated information. While we employ a multi-step quality pipeline including citation verification, plagiarism screening, and human editorial review, we do not guarantee the accuracy, completeness, or timeliness of any content. All factual claims are backed by cited sources, but errors may occur.

3. No Reliance

You should not make business, financial, legal, or policy decisions based solely on Operithm reports without independent verification and consultation with qualified professional advisors. Operithm expressly disclaims any liability arising from reliance on report content.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPERITHM'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC REPORT GIVING RISE TO THE CLAIM.

IN NO EVENT SHALL OPERITHM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. Some jurisdictions, including certain EU member states, limit the ability to disclaim liability for gross negligence or intentional misconduct.

5. Intellectual Property & Licensing

Operithm retains all intellectual property rights in its reports. Human editorial review contributes to the originality and copyrightability of each report.

Upon purchase, you receive a license under one of two tiers:

• Individual License: Non-exclusive, non-transferable license for a single natural person for personal or professional use only. No sharing, redistribution, or reproduction.
• Enterprise License: Non-exclusive, non-transferable license for internal use within the purchasing organization only. No external distribution.

Resale, sublicensing, and redistribution of reports are strictly prohibited. You may not remove watermarks, metadata, or AI disclosure notices from any report.

6. Citation & Third-Party Content

Reports cite third-party sources under fair use for purposes of commentary, research, and analysis. Citations are references to source material and do not constitute endorsements by the cited authors or publishers. Operithm does not claim ownership of cited third-party content.

7. Acceptable Use

You agree not to:

• Use reports to provide professional advice to third parties
• Misrepresent the authorship of reports
• Remove or alter attributions, watermarks, or AI disclosure notices
• Scrape, bulk-download, or systematically access the Service
• Share login credentials or allow unauthorized access to your account
• Use the Service for any unlawful purpose

We reserve the right to terminate accounts for violations of these Terms.

8. Refund Policy

EU consumers: Under the EU Consumer Rights Directive, you have a 14-day right of withdrawal for digital content purchases. However, by consenting to immediate access at checkout and acknowledging the loss of your withdrawal right, you waive this right once you access the report.

Non-EU users: We offer a reasonable refund for reports that are materially defective or were not delivered. Contact us within 14 days of purchase.

9. Governing Law

These Terms shall be governed by applicable law. EU consumers retain the right to bring proceedings in their home jurisdiction regardless of these Terms.

10. Changes to Terms

We may update these Terms from time to time. We will notify registered users of material changes via email or prominent notice on the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
